CODE VIOLATION DESC : LEGAL USE: Per bldg permit #8502492 completed 2/24/1986: subject building is a 3 story 2 dwelling units wood frame building; 3rd floor is individual dwelling unit. 2nd floor is individual dwelling unit. Ground floor is parking garage, separate laundry room, separate powder room without bathing facilities, one large social room 21'x29' with NOTICE OF SPECIAL RESTRICTIONS UNDER THE CITY PLANNING CODE (recorded document #D624030). An enclosed 3 story interior stairs connects all levels with openings at 1st, 2nd, and 3rd floors. VIOLATIONS: Without permits ground floor spaces were partitioned to create two bedrooms and a living room and a kitchen. Bathing facilities were added to the powder room. Recorded document #D624030 "NOTICE OF SPECIAL RESTRICTIONS UNDER THE CITY PLANNING CODE" states in part "The plans filed with the present application indicate on the garage level at 570-572 - 40th Ave.: one social, family or recreational room with wetbar, no bedrooms and one-half bath, said rooms having independent access to the street by way of a laundry room and hall." "... that said garage level shall be used only as accessory to the dwelling above..."
