Description: 500 Beale St. Bayside Village --- Customer would like a call back regarding this complaint. Customer states there are construction workers at this location doing renovation work on units inside the building. Yesterday I saw 2 of the workers outside of my unit and they were violating the face covering. These 2 workers were not wearing face mask/covering. I ask them if they would put on a face covering, first they said yes and one of them was eating in the hallway. Then I asked do you have a face mask and they said yes, but did not do anything to get a face mask/covering to put on. I ask can I record you and they said yes. Then I recorded them. I ask can you please tell me why you are not wearing a mask and they just ingonored me. I then called Bayside Village emergency security number. They sent a security manager with a security guard. The security manager came and asked these 2 workers to wear a mask and they said yes but they had to go somewhere else to pick it up and then they  
 
Instructions: started to wear the mask. Then the security manager left. At 8PM I went outside of my unit and I found one of the same 2 workers in the hallway without the mask on. He was not suppose to be here at 8PM because they are only suppose to work until 6PM. I asked him why he was not wearing a mask and he said nothing and I recorded him a second time not wearing a mask/covering. So then I called again to Bayside Village securtiy but it was after hours, the call center answered and they never sent anyone. I was alone with this gentleman in the hallway with no one who could assist me. I sent the video to the manager of the residence. I asked them not to have these 2 workers coming again today, but I saw one of them working in the unit next to mine again. in the email I sent to the security to Bayside Village I told them that I was going to call 311 if they were going to send again those same 2 workers and I guess they didn't care, because they sent them again. I looked at the Covid-19 protocol on SF.Gov and I believe this construction project should follow the requirements of the order of the health officer number C19-07C appendix B-2, it is called large construction project safety protocol and they are not compliant with this order for multiple reasons. Customer states my security manager was blaming me like I was not following the law and did not taking me seriously. I don't feel safe with these workers not complying with the health order. Customer would like a call back regarding this issue. (311 SR#12627101)

(Building 8) 501 Delancey St. (Building 9) --- I am writing to inform you of continued gross violations of the COVID-19 Health Orders by Bayside Village (multifamily property owned by Brookfield Properties in South Beach, SF). On March 2nd 2020, Bayside Village began an extensive non-essential remodeling project on vacant units in all 9 buildings on the property. This remodeling has continued throughout the past 5 months, violating multiple Health Orders from March 31st to present. These violations include unmasked workers, and never assigning a COVID-19 Safety Compliance Officer on-site (Appendix B-2 of Health Order C019-07f - Large Construction Safety Protocol- that includes renovation work on more than 10 units). The first complaint regarding gross negligence of safety was filed for 500 Beale Street (building 5), on July 9th. The inspector sent from DBI observed work being performed without permits. This inspection and subsequent fine due to the violation did not deter Bayside Village from continuing violating the Health Order. Last week due to further violations yet another complaint needed to be filed regarding unmasked workers for 3 Bayside Village Place (building 8). In follow-up with DBI they stated that there is no system in place to enforce Appendix B-2. Rather the inspector told us that our situation is unique in that they have never seen an instance in which a warning has been issued, and that noncompliance persisted, as in the case of Bayside Village. We ask that more action be taken in regard to Bayside Village's blatant disregard for COVID safety for the past 4 months. Continued below (311 SR#12752403) Cheryl Lee 10-AUG-20BID
08/10/20OTHER BLDG/HOUSING VIOLATIONTiendaCASE UPDATE-cont- (311 SR#12752403)An issue of particular concern that needs immediate attention is that this coming week (starting August 10th), Bayside Village will be renovating 21 units from Monday-Saturday 9am-5pm putting all its residents at risk. There is still nothing in place of the requirements of the Appendix B-2. There is no COVID-19 Safety Compliance Officer name posted at any entrances/exits (let alone hired at all), no Site-Specific Health and Safety plan, no wash stations/hand sanitizers for workers, no signs translated in multiple languages with safety instructions for the workers. Nothing. If DBI cannot enforce the Health Order, then we plead that the Department of Health should request an inspector to stop these violations, and force Bayside Village to comply with the Health Order to protect its residents and in turn the wider San Francisco area.
